By accessing or using the AC Tech website and AI-powered diagnostic assistant (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE NOTE THAT THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER AS DETAILED IN SECTION 9. THESE PROVISIONS AFFECT HOW DISPUTES BETWEEN YOU AND AC TECH ARE RESOLVED.

2. Description of Service

AC Tech provides an AI-driven tool designed to assist HVAC technicians in diagnosing system issues. The Service analyzes user inputs and images to suggest possible causes and solutions.

The Service is an assistive tool only. It does not replace professional training, certification, or on-site judgment. You acknowledge that you retain full responsibility for all diagnostic and repair decisions.

3. User Accounts

To access certain features, you must create an account. You responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Scraping: Using any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.
• Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any aspect of the Service or its underlying AI models.
• System Abuse: Interfering with or disrupting the integrity or performance of the Service, including overwhelming the system with excessive requests.
• Illegal Content: Using the Service to generate or disseminate fraudulent, defamatory, or illegal content.

5. Intellectual Property & Data License

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of AC Tech and its licensors.

Your License to Us: By submitting text, images, or other data ("User Content") to the Service, you grant AC Tech a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of operating, improved, and training our AI models and Service.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

AC TECH MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE DIAGNOSTICS OR INFORMATION PROVIDED BY THE AI. THE AI CAN HALLUCINATE OR PRODUCE INCORRECT INFORMATION. ALWAYS VERIFY OUTPUTS WITH STANDARD INDUSTRY PRACTICES.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AC TECH, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless AC Tech from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including any physical injury or property damage resulting from your reliance on the Service.

9. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
